UAE onshore courts

The default for most UAE-connected disputes. Proceedings in Arabic, civil-law procedure, and the widest reach for enforcement against local assets.

DIFC Courts

An English-language, common-law jurisdiction inside Dubai with its own laws, disclosure obligations and costs consequences.

ADGM Courts

Abu Dhabi Global Market — a separate common-law jurisdiction applying English law directly, with its own courts and rules.

Arbitration

Private, confidential and governed by the clause: the seat, rules and tribunal you agreed. Often chosen for cross-border enforceability.

The clause wins

Where the contract expressly and validly elects a forum, that election generally governs — which is why the drafting stage matters more than the dispute stage.

The forum that produces the most enforceable outcome against the assets that actually exist is usually the right one, whatever feels familiar.

What happens if I file in the wrong court?

The claim can be dismissed or stayed on jurisdictional grounds, costing time and fees and sometimes handing the other side an advantage. Because jurisdiction is a threshold issue that will be tested, it is worth resolving before filing rather than after.

Our contract has no jurisdiction clause. What then?

Jurisdiction is determined by connection factors instead — where the parties are registered, where the contract was performed, and where the subject matter or assets sit. It is a more contested analysis, and both sides may argue for the forum that suits them.

Can I choose the DIFC Courts even if my business is onshore?

Parties commonly include an express DIFC jurisdiction clause. Whether it is effective depends on drafting and circumstances, so a clause copied from a template is worth reviewing before you rely on it.

Is arbitration better than court?

Not automatically. It offers confidentiality, procedural flexibility and often better cross-border enforceability, but institutional and tribunal fees are real and speed depends on the tribunal. It suits some disputes and not others.

Where should enforcement fit into the decision?

At the beginning. A judgment or award is only useful where it can be executed against assets that exist. Choosing a forum without checking where the counterparty's assets sit is how people win cases and still collect nothing.
